RESOLVED: that the minutes for the Panel meeting on 10 December 2024 be approved and signed as a correct record.

Report of the Director of Transport and Planning recommending that the Panel delegate approval in respect of an application for a proposed development at the above address.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that the application that authority be delegated to the Head of Transport and Planning to grant planning permission subject to the criteria listed in the report.

 

Erection of four x 4 bed detached dwellings with landscaping, drainage and associated works with access onto Leah Close.

 

Andrew Taylor and Lisa Waghorne (local residents/ objecting), Jack Bell and Councillor Wood (Ward councillors) were present and with the consent of the Chair, addressed the meeting. In addition the Panel noted that a statement had been received, circulated, read and posted online from Andrew Taylor and Hugh Murray.

 

The presenting officer reported to the Panel that an additional 3 extra conditions relating to site access were needed  as set out below.

 

Upon being put to the vote the Panel confirmed the Habitats Regulation Assessment.

 

The Panel then considered recommendation 2 that the application be delegated to the Director of Transport and Planning to grant planning permission subject to criteria listed in the report (as amended) and recommendations (3) and (4).  Upon being put to the vote the recommendations were carried unanimously.

 

RESOLVED

 

1.  To confirm the Habitats Regulation Assessment set out in Appendix 1 of the report.

2.  That authority be delegated to the Director of Transport and Planning to grant planning permission subject to

a.   the conditions in the report and any additional or amended conditions or planning obligations set out below; and

b.  the completion of a Unilateral Undertaking or S.111 Agreement to secure a scheme of measures or a financial contribution to mitigate against the pressure on European designated nature conservation sites in accordance with Policy CS22 of the Core Strategy and the Conservation of Habitats and Species Regulations 2010.

3.  That the Director of Transport and Planning be granted delegated powers to add, vary and/or delete conditions as necessary; and

4.  In the event that a financial contribution towards the Solent Disturbance Mitigation Project is not secured within 1 month following the Panel meeting, the Director of Transport and Planning be authorised to refuse permission on the grounds of failure to mitigate the development's impact upon the ecological importance of the Special Protection Areas (SPA) within and around the Solent.

 

 

 

NOTE:  Councillor Wood had withdrawn from the Panel in order to make representation on behalf of her Ward.

 

Additional conditions

 

Leah Close Pre-Development Highway Condition Survey. (Pre-commencement)

Prior to the commencement of the development an existing condition survey for the highway and kerbing of Leah Close shall be submitted to and approved in writing by the Local Planning Authority, which includes:

·  A survey and written report, including plans, photographs and descriptions of defects to the existing highway.

REASON: To identify the pre-construction condition of Leah Close, to enable repair works to be agreed to a suitable & reasonable standard.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that the application that authority be delegated to the Head of Transport and Planning to grant planning permission subject to the criteria listed in the report.

 

Change of use from HMO (Class C4) to 7-person HMO (Sui Generis).

 

Carrieanne Wells (agent), was present and with the consent of the Chair, addressed the meeting. In addition the Panel noted that statements had been received, circulated, read and posted online from Elizabeth Moore, Mr & Mrs Argyle, Ann-Zara Newman, Mr & Mrs Pearce. Mr and Mrs Bagnell and the Highfield Residents Association.

 

The presenting officer reported that the Highways department had verbally updated them to state they had no objection and that residents would not be entitled to parking permits.  They also noted the additional statements from the members of the public and clarified the differences between the application and an appeal decision provided for a site at 61 Highfield Crescent.  In addition clarification was given on joint and separate tenancy agreements explaining that these were not material to the planning application. 

 

The planning officer also: amended condition 4 in relation to bin/cycle  storage;  and added a further condition regarding noise insulation for bedrooms 1 and 2 as set out below. 

 

Upon being put to the vote the Panel confirmed the Habitats Regulation Assessment.

 

The Panel then considered recommendations that authority be delegated to the Director of Transport and Planning to grant planning permission subject to criteria listed in the report as amended and recommendation (3).  Upon being put to the vote the recommendations, as amended, were carried.

RESOLVED

 

1.  To confirm the Habitats Regulation Assessment set out in Appendix 1 of the report.

2.  To grant delegated authority to the Director of Transport and Planning to grant planning permission subject to the planning conditions recommended at the end of this report and the payment of a contribution towards the Solent Disturbance Mitigation Project (SDMP)

3.  In the event that the contribution is not secured within a reasonable period following the Panel meeting, the Director of Transport and Planning be authorised to refuse permission on the ground that the proposal has not secured adequate mitigation towards in combination impacts on the Solent and Southampton Water Special Protection Area.

 

NOTE  Councillor Greenhalgh withdrew from the Panel with ill health.

 

Amended condition

 

04. Cycle Storage and Bin Storage (Occupancy Condition)

 

Prior to occupation of the rooms labelled bedroom 1 and bedroom 2 on the approved plan the submitted and approved bin and cycle storage scheme shall be implemented in full. Upon implementation of the approved scheme specified in this condition, that scheme shall thereafter be retained for the lifetime of the development.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that the application be delegated to the Director of Transport and Planning to grant planning permission subject to the criteria listed in the report.

 

Change of use from Class C3 (dwellinghouse) to Class C2 (Residential Care Home)

 

Graham Bradford and Linda Milczarek (local residents objecting), and Councillors Goodchild, Mcmanus and Whitbread (ward councillors/objecting) were present and with the consent of the Chair, addressed the meeting. In addition the Panel noted that statements had been received, circulated, read and posted online from Bob and Carol Hedges and Kaan Taskin.

 

The presenting officer reported that a verbal statement of no objection had been received from the Highways department.  In addition it was confirmed from adult social services that the potential care home would not be a Council run facility but that it would be controlled by the Care Quality Commission.

 

During discussion on the item member expressed their concernes that the management plan was not robust enough to  mitigate the concerns of the residents and Ward Councillors.  In response officers agreed to amend  Condition 5 to reflect their concerns, as set out below. 

 

Upon being put to the vote the Panel confirmed the Habitats Regulation Assessment.

 

The Panel then considered recommendation that the application be delegated to the Director of Transport and Planning to grant planning permission subject to criteria listed in the report (as amended).  Upon being put to the vote the recommendation was carried unanimously.

 

 

RESOLVED

 

1.  That the Panel confirm the Habitats Regulation Assessment in Appendix 1 of this report.  This confirms that there will be no net impacts on the Special Protection Areas.

2.  that planning permission be approved subject to the conditions set out within the report and the amended conditions set out below.

Changes to conditions

 

05. On-site Management (Occupancy Condition)

 

Notwithstanding the submitted management plan dated 8th January 2025, no occupation of the property of any kind shall take place unless and until a satisfactory operational management plan has been submitted to and approved in writing by The Local Planning Authority. The use hereby approved shall be operated in full accordance with the operational management plan thereafter.

 

REASON: to protect the amenities of neighbouring properties in accordance with saved Policies SDP1(i) and SDP16 of the City of Southampton Local Plan Review (2015).

 

Note to Applicant

In addition to the information already provided the updated Management Plan should provide further details of how any noise, disturbance and/or antisocial behaviour emanating from the site will be dealt with by the operators and on-site management.  It should provide clear details of how neighbours can report such behaviour with details of how any complaints procedure will be operated and made clear to neighbours.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that the application be conditionally subject to the criteria listed in the report.

 

Application for variation of condition 2 (Management plan) of planning permission ref 23/00882/FUL (Change of use of residential outbuilding to a beauty salon) to allow opening hours of 09:00 - 20:00 Monday - Saturday and 10:00 - 18:00 Sunday and public holidays and to allow for 1 employee. 

 

Sanjeev Sharma (applicant), was present and with the consent of the Chair, addressed the meeting. In addition the Panel noted that a statement had been received, circulated, read out at the meeting then posted online from David Meadows.

 

During discussion on the item, Members discussed the potential for the hours of business (set out in the conditions and the description) to disrupt a residential area.  Councillor Beaurain and Blatchford moved a motion that the condition on hours be amended to remove any hours of operation on Sundays and public holidays.  Upon being put to the vote the motion to amend the working hours was defeated on the use of the Chair’s casting vote. 

 

The Panel then considered recommendation that the application be conditionally approved to grant planning permission subject to criteria listed in the report.  Upon being put to the vote the recommendation was carried.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that the application be conditionally approved subject to the criteria listed in the report.

 

Change of use from a dwelling house (Class C3) to a house in multiple occupation (HMO, Class C4).

 

Liesbeth Meilink, Tim Wildschut and Peter MacCallan (local residents/ objecting), John Asiamah (agent), and Councillors Shields and Kenny (ward councillors) were present and with the consent of the Chair, addressed the meeting. In addition the Panel noted that a statement had been received, circulated, read and posted online from Mr and Mrs Kirkcaldy.

 

The presenting officer reported that there was an error in the report detailing the size of bedroom 4 and detailed the correct dimensions to the meeting.

 

During discussion on the item, members raised the issue and officers agreed to amend their recommendation by the amendment of condition 7, as set out below.

 

 

The Panel then considered recommendation that the application be conditionally approved subject to criteria listed in the report (as amended).

 

RESOLVED that planning permission be approved subject to the conditions set out within the report and any additional or amended conditions set out below.

AMENDED CONDITIONS

 

07. Noise Insulation (Prior to occupation condition)

 

Prior to first occupation as a House in Multiple Occupation a scheme for noise insulation of floor to ceiling height of the party walls (including roof space) shall be installed in accordance with details that have first been submitted to and approved in writing by the local planning authority. Upon implementation of the approved scheme specified in this condition, that scheme shall thereafter be maintained for the lifetime of the development.

 

REASON: to protect the amenities of neighbouring properties in accordance with saved Policy SDP16 of the City of Southampton Local Plan Review (2015).
