Exclusion Of The Press And Public - Legal Advice At a predetermined point during the consideration of all items the Sub-Committee may move into private session in order to receive legal advice when determining issues. The parties to the hearing, press and the public, unless otherwise excluded by the Licensing Act 2003 (Hearings) Regulations 2005, will be invited to return immediately following that private session at which time the matter will be determined and the decision of the Sub-Committee will be announced. Minutes: RESOLVED: that the Sub-Committee move into private session in order to receive legal advice when determining issues. Following that private session, at which time the matter had been determined, written confirmation of the decision of the Sub-Committee was distributed to all parties to the hearing. |

Minutes: The Sub-Committee considered the application for the variation of the Sexual Entertainment Venue (SEV) licence at Playhouse Gentlemen’s Club, Basement, 35 London Road, Southampton SO15 2AD.
It gave due regard to the provisions under the Local Government (Miscellaneous Provisions) Act 1982.
The Sub-Committee considered very carefully the application submitted by the applicant and the report submitted by the Executive Director Communities Culture & Homes.
The Sub-Committee also gave due regard to the answers provided to questions at the hearing.
The Sub-Committee noted the applicant’s request to make the following four variations to the license:
1. Variation to the hours of operation to permit the premises to open earlier (from1900 hours). 2. Variation to the conditions of the sexual entertainment venue licence. 3. Variation to the exterior of the premises, to include new signage. 4. Variation to the interior layout of the premises.
Having considered all the above matters the Sub-Committee:
RESOLVED to grant all variations as per the application.
Reasons
Paragraph 18 of the Local Government (Miscellaneous Provisions) Act 1982 provides that the holder of a sexual entertainment venue (SEV) licence may at any time apply for any variation of the terms, conditions, or restrictions on or subject to which the licence is held.
The Hampshire Constabulary Force Licensing Team had advised that they had no objection to the application, having been consulted by the licence holder and having visited the premises prior to application. The Sub-Committee noted that the police had agreed to the variations requested.
The Sub-Committee noted that there had been full consultation, including several meetings, with the Licensing Manager and no objection to the variations had been raised. The Senior Licensing Officer confirmed that the Licensing Team was content with the application.
There was no compelling evidence presented to the Sub-Committee that justified refusal of the application or any reason for amendments to the variations applied for.
