Approval of a Section 75 Agreement and a Facilities Agreement for the Oak Lodge Project, Bitterne

THE DECISION

To approve the proposals / recommendations contained in the report without modification as set out below.
(i) Retrospective approval for an agreement made pursuant to Section 75 National Health Service Act 2006 between the Council and Southampton City Primary Care Trust (SCPCT) upon terms as agreed by the Solicitor to the Council to enable the payment of Registered Nursing Care Charge by SCPCT to the Council for the commissioning by the Council of nursing care under Section 49 Health and Social Care Act 2001.

(ii) That the Executive Director of Communities, Health and Care be authorised to enter into a Facilities Agreement with BUPA for the provision of food and beverages to the Day Centre users from the Care Home kitchen.  

 

REASONS FOR THE DECISION

1. The Council has agreed to lease, and has executed an Agreement for Lease, with BUPA, for a period of 50 years, the land situated at Oak Lodge for the provision of the Care Home, which will be a new build, with adjoining facilities for a Day Centre. Cabinet resolved on the 7th January 2008 to dispose of the site having achieved best value consideration and certified by SCC Legal Services and sanctioned the provision by the Solicitor to the Council of a Section 3 Certificate under the Local Government (Contracts) Act 1997 in order to complete the disposal.
