Election of Vice-Chair

To elect a Vice-Chair to the Sub-Committee for the 2010/11 Municipal Year.

Minutes:

RESOLVED that Councillor Willacy be elected Vice-Chair of the Sub-Committee for the 2010/2011 Municipal Year.

Apologies And Changes In Membership (If Any)

To note any changes in the membership of the Sub-Committee made in accordance with Council Procedure Rule 4.3.

 

Minutes:

The Panel noted that Councillor Osmond and Councillor Rayment were in attendance as nominated substitutes for Councillors Fitzgerald and McEwing accordance with Council procedure Rule 4.3.

To approve and sign as a correct record the Minutes of the meeting held on 7th April 2010 and to deal with any matters arising, attached.

RESOLVED that the Minutes of the meeting held on 7th April 2010 be signed as a correct record. (Copy of the minutes circulated with the agenda and appended to the signed minutes).

Exclusion Of The Press And Public

At a predetermined point during the consideration of item 7 the Sub-Committee may move into private session in order to receive legal advice when determining issues.  The press and the public, unless otherwise excluded by Category 4 of paragraph 10.4 of the Council's Access to Information Procedure Rules, will be invited to return immediately following that private session at which time the matter will be determined and the decision of the Sub-Committee will be announced.

 

Chair to move that in accordance with the Council's Constitution, specifically the Access to Information Procedure Rules contained within the Constitution, the press and public be excluded from the meeting in respect of item 8 based on Categories 1 and 2 of paragraph 10.4 of the Access to Information Procedure Rules.

The information contained therein is potentially exempt as it relates to individual personal details and information held under the Data Protection Act 1998. Having applied the public interest test it is not appropriate to disclose this information as the individuals' legal expectation of privacy outweighs the public interest in the exempt information.

RESOLVED

 

(i)  the press and public, unless otherwise excluded by Category 4 of that paragraph 10.4 of the Council’s Access to Information Procedure Rules be excluded from the meeting in respect of Minute No 5 and  be invited to return immediately following private session at which time the matter be determined and the decision of the Panel be announced;

The Sub-Committee considered the report of the Solicitor to the Council detailing a request for the renewal of a sex shop licence in respect of A Taste of Amsterdam, 437 Millbrook Road West. (Copy of report circulated with agenda and appended to signed minutes).

 

The Sub-Committee considered the decision in confidential session in accordance with Category 4 of Paragraph 10.4 of the Council’s Access to Information Procedure Rules

 

RESOLVED that the application for renewal of a sex shop licence in respect of A Taste of Amsterdam, 437 Millbrook Road West be granted on the terms and conditions as set out in the report.

 

REASON FOR THE DECISION

There was no compelling evidence presented to the Sub-Committee that would justify refusal of the application for renewal of the licence.

Application for a Sex Shop Licence - Adult Gift Shop, 90 Howard Road

Confidential report of the Solicitor to the Council regarding an Application for a Sex Shop Licence - in respect of Adult Gift Shop, 90 Howard Road, attached.

Minutes:

The Sub-Committee considered the confidential report of the Solicitor to the Council detailing a request for the renewal of a sex shop licence in respect of the Adult Gift Shop, 90 Howard Road.

 

Mr M Hale (Applicant) together with Mr J Hale were present and with the consent of the Chair addressed the meeting.

 

The Sub-Committee considered the decision in confidential session in accordance with Category 4 of Paragraph 10.4 of the Council’s Access to Information Procedure Rules.

 

RESOLVED that the application be refused.

 

 

REASON FOR THE DECISION

 

After full and careful consideration of all the evidence before them including the applicant’s previous convictions that were deemed relevant to the application the Sub-Committee were of the view that the applicant was not a fit and proper person to hold a licence.
