To consider a report of the Cabinet Member for
Finance and Capital Assets in consultation with the Cabinet Member
for Growth seeking approval for Exceptional Circumstances Relief
for the Bargate Development and its Community Infrastructure Levy
payments.
Modified recommendations:
(i) Consider the 4 options set out in the report;
(ii) Accept a partial claim as set out in Option 1 below, whereby a significantly reduced CIL contribution is sought given the exceptional heritage circumstances associated with the Bargate Centre’s context and redevelopment proposals; and
(iii) Allocate the outstanding £520k CIL payment towards maintenance and repair works to the North Town Walls.
OPTION 1 – Compromise
In this option, the Council could offer relief for a 46% of the remaining £965,116 CIL charge in the knowledge that £2,080,521 has already been secured. The Head of Culture and Tourism has indicated that they are investigating the need for urgent maintenance works to the northern section of the Town Walls. These works are estimated to cost £520k and could be collected from the developer’s CIL meaning that the remaining would be waived.
OPTION 2 - Support the Claim
In this option, the Council would formally waive £965,116, and accept that the site constraints and heritage assets that will be supported by opening up the Town Walls as proposed are truly ‘exceptional’.
OPTION 3 - Reject the Claim – Accept Phased Payments
This is the option recommended by the Council’s Executive Director for Finance and Commercialisation, although the option of phased payments to ease cashflow could certainly be explored. In this option the Council would seek the remaining balance of £965,116 from the applicant. However, in recognition of the financial challenges the payment could be delayed to await improved cashflow benefits from the project helping the developer with the payment. These monies could be collected as the scheme is nearing completion rather than upfront.
OPTION 4 – Reject the claim entirely
No phased payments and payment at commencement of the Planning Permission.
