RESOLVED: that the minutes for the Panel meeting on 4 March 2025 be approved and signed as a correct record.

Report of Head of Service seeking permission to confirm a tree preservation order with an outstanding objection.

The Panel considered the report of the Executive Director of Residential Services setting out the objection received in the making and serving of a tree preservation order that protects a sycamore in the front garden of number 9 Rossington Avenue.

 

There were no members of public present wishing to address the Panel. The presenting officer noted that there were no updates. 

 

RESOLVED that the Panel confirmed The Southampton (9 Rossington Avenue) Tree Preservation Order 2024 without modification.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that authority be delegated to the Director of Transport and Planning to grant planning permission subject to the criteria listed in the report.

 

Redevelopment of the site and erection of purpose built student accommodation comprising three to six storey blocks containing 162 bedspaces with provision of new access and associated vehicular drop off zone and landscaping (amended description).

 

Ros Cassy and Councillor Evemy (local residents/ objecting), Sarah Beuden (agent), John Steven (applicant), and Councillor Bogle (ward councillor) were present and with the consent of the Chair, addressed the meeting. In addition the Panel noted that a statement had been received, circulated, read and posted online from Councillor Bogle.

 

The presenting officer reported that additional comments had been received on the report since the publication of the report but that their comment reiterated the considerations set out in the report and responded to within the report.  It was explained that a further clause had been added to the S106 to address Dolphin lane, as set out below

 

Upon being put to the vote the Panel confirmed the Habitats Regulation Assessment.

 

The Panel then considered the remaining recommendations that authority be delegated to the Director of Transport and Planning to grant planning permission subject to criteria listed in the report.  Upon being put to the vote the recommendations, as amended, were carried.

RESOLVED

 

1.  To confirm the Habitats Regulation Assessment set out in Appendix 1 of the report.

2.  That authority be delegated to the Director of Transport and Planning to grant planning permission subject to the conditions in the report [and any additional or amended conditions or planning obligations set out below] and the completion of a S.106 Legal Agreement to secure :

  i.  Either the developer enters into an agreement with the Council under s.278 of the Highways Act and/or undertakes a scheme of works or provides a financial contribution towards site specific transport contributions for highway improvements in the vicinity of the site in line with Policy SDP4 of the City of Southampton Local Plan Review (as amended 2015), policies CS18 and CS25 of the adopted LDF Core Strategy (as amended 2015) and the adopted Developer Contributions SPD (April 2013);

  ii.  In lieu of an affordable housing contribution an undertaking by the developer that only students in full time education be permitted to occupy the development and that the provider is a member of the Southampton Accreditation Scheme for Student Housing (SASSH) or equivalent, in accordance with Core Strategy Policy CS15.

  iii.  Submission of a highway condition survey (both prior to and following completion of the development) to ensure any damage to the adjacent highway network attributable to the build process is repaired by the developer.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that the application be refused

 

Erection of a two-storey three bedroom dwelling.

 

Mr Axton (local residents objecting), Carl Patrick (agent), and Councillor Keogh (ward councillor) were present and with the consent of the Chair, addressed the meeting. In addition the Panel noted that  statements had been received, circulated, read and posted online from Mr Tony Richie -Webber

 

The Panel then considered recommendation that the application be refused. Upon being put to the vote the recommendation was carried unanimously.

 

RESOLVED that planning permission be refused for the reasons set out below:

 

Reasons for Refusal

 

1.  The proposed access arrangements for this new dwelling, by reason of the backland location and distance from the public highway, are not considered safe and suitable for a new dwelling (particularly in the event of a fire) as they would not comply with current fire safety requirements as advised by Hampshire Fire & Rescue in response to a notification of this application.  As such, the application has been assessed as contrary to saved Policy SDP1(i) of the City of Southampton Local Plan Review 2015, as they would affect the safety and amenity of the city and its citizens. In addition, the proposals would be contrary paragraph 115(b) of the National Planning Policy Framework (2024), which seeks to ensure safe and suitable access to new development

2.  In the absence of either a scheme of works or a completed Section 106 legal agreement or unilateral undertaking to support the development the application fails to mitigate against its wider direct impact with regards to the additional pressure that further residential development will place upon the Special Protection Areas of the Solent Coastline and in the New Forest.  Failure to secure mitigation towards the 'Solent Disturbance Mitigation Project' and the New Forest Special Protection Area, in order to mitigate the adverse impact of new residential development (within 5.6km of the Solent coastline) on internationally protected birds and habitat is contrary to Policy CS22 of the adopted Local Development Framework Core Strategy Development Plan Document (2015) as supported by the Habitats Regulations

Change of use from House in Multiple Occupation (Class C4) to 7-bedroom HMO (Sui Generis).

 

Councillor Evemy (ward councillor) were present and with the consent of the Chair, addressed the meeting.

 

The presenting officer reported that an additional correspondence address had been received from the City Council’s HMO teams raising no objection to the proposal

 

Upon being put to the vote the Panel confirmed the Habitats Regulation Assessment.

 

The Panel then considered the remaining recommendations that authority be delegated to the Director of Transport and Planning to grant planning permission subject to criteria listed in the report and recommendation 3 that authority be delegated to refuse planning permission should the applicant not secure adequate mitigations the Solent and Southampton Water Special Protection Area.

 

 Upon being put to the vote the recommendations were carried unanimously.

 

RESOLVED:that the Panel:

 

  i.  Confirmed the Habitats Regulation Assessment in Appendix 1 of the report.

 

  ii.  Delegated authority to the Director of Transport and Planning to grant planning permission subject to the planning conditions and the payment of a contribution towards the Solent Disturbance Mitigation Project (SDMP)

 

  iii.  Delegated authority to the Director of Transport and Planning to refuse permission in the event that the contribution is not secured toward the Solent Disturbance Mitigation Project (SDMP) as an adequate mitigation towards in combination impacts on the Solent and Southampton Water Special Protection Area within a reasonable period following the Panel meetin.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that the application be conditionally approved subject to the criteria listed in the report.

 

Erection of single-storey side extension and side/rear extension following demolition of existing lean-to, outbuilding and garage, installation of raised patio and disabled access ramp/bridge

 

Debendra Sahu (local resident objecting), Colette Harrison (agent), were present and with the consent of the Chair, addressed the meeting. In addition, the Panel noted that a statement had been received, circulated, read and posted online from Debendra and Aswita Sahu.

 

The presenting officer reported the receipt of amended Plans, which removed the plant room, and made minor changes to the external appearance of the building.  Condition 6 (Plant Room and noise) was therefore not required ad removed by officers.

 

The Panel then considered recommendation that the application be conditionally approved subject to criteria listed in the report (as amended). Upon being put to the voted the recommendation was caried unanimously. 

 

RESOLVED that planning permission be approved subject to the conditions set out within the report and the removal of Condition 6.

 

NOTE: Councillor Blatchford withdrew from the meeting after declaring an interest

During discussion on the item, a motion to amend the recommendation by a variation to the condition 4 (hours of use) as set out in full below, was proposed by Councillor Beaurain and seconded by Councillor Blatchford.  Upon being put to the vote, the amendment to the recommendation was carried.

 

The Panel then considered recommendation that the application be conditionally approved be subject to criteria listed in the report as amended.  Upon being put to the vote the recommendation as amended was carried.
