Exclusion of the Press and Public - Exempt Papers included in the following Item

To move that in accordance with the Council’s Constitution, specifically the Access to Information Procedure Rules contained within the Constitution, the press and public be excluded from the meeting in respect of any consideration of the exempt appendix 1 to the following item.

Appendix 1 of this report contains information deemed to be exempt from general publication based on Category 3 of Paragraph 10.4 of the Council’s Access to Information Procedure Rules. This includes details of commercial terms and standings, which if disclosed could put the Council or other parties at a commercial disadvantage. It is not in the public interest to disclose this information as the report contains confidential and commercially sensitive information in relation to one of the Council’s suppliers. It would prejudice the Council’s ability to operate in a commercial environment and obtain best value in contract negotiations.

NOTE:  This report is submitted for consideration as a general exception under paragraph 15 of the Access to Information procedure Rules in Part 4 of the Council’s Constitution, notice having been given to the Chair of Overview and Scrutiny Management Committee and the public.

 

The matter requires a decision on 29 April, 2025. The urgency is due to the extremely tight timeframes required to appoint a new contracted operator for Southampton’s leisure facilities, ahead of May.   For these reasons the decision cannot be deferred for inclusion in the next Forward Plan for decision following 28 clear days notice.

In applying the public interest test this information has been deemed exempt from the publication due to commercial sensitivity. It is not considered to be in the public interest to disclose this information as it would reveal information which would put the Council at a commercial disadvantage.
